The law changes the federal definition of hemp from a Delta-9 THC standard to a total THC standard that includes THCA, capped at 0.3% dry weight.

The most devastating provision: a strict cap of 0.4 milligrams of total THC per container for finished hemp products. That is not per serving — per container. Industry analysts estimate 95% of existing hemp-derived cannabinoid products — including gummies, vapes, beverages, and tinctures — will become non-compliant. Synthetic cannabinoids are explicitly excluded from the hemp definition entirely.

Florida already enforces a 0.4mg total THC per serving rule through the Department of Agriculture, but the federal per-container limit is far more restrictive. The Florida Legislature's 2026 session, which began January 13, could align state law with the federal standard before the November deadline. Home Grow Bill Dies in Committee — Again

Senate Bill 776, which would have allowed qualified medical marijuana patients to cultivate up to six flowering cannabis plants at home for personal use, died in the Health Policy committee on March 13, 2026. The bill never received a committee hearing. Florida remains one of the few medical marijuana states that completely prohibits patient home cultivation.

The bill's sponsor cited cost savings for patients — home cultivation could reduce a patient's annual cannabis spending from $3,000-$5,000 down to a few hundred dollars per year.
